Most eavestrough jobs are a ladder, a bucket and an hour. This one paused halfway through, because the pipe carrying half of this roof's water down to the ground was not on this homeowner's land. It was on the land next door, past a line neither household had ever had a reason to think about. You cannot flush a downspout you are not allowed to stand beside.

What sixteen years in an eavestrough looks like

Quick answer: After 16 years the debris in a Burlington eavestrough is no longer leaves. It is soil. On August 24, 2026 the troughs on this house held a compacted black layer of decomposed leaf matter mixed with shed asphalt granules, deep enough to grow live moss above the front entry.

The giveaway was the moss. Moss cannot root on bare aluminium, so a trough with moss in it is telling you the contents finished decomposing some time ago and turned into a growing medium. That takes years, not one skipped autumn. Under the moss was the second half of the story: a dark, gritty layer that is mostly asphalt granules shed by the shingles above, washed into the trough one rainfall at a time and settled at the bottom where they hold water like wet sand.

Neither layer flushes out with a hose. Water runs over the top of compacted debris the way a stream runs over a riverbed, which is exactly why homeowners who rinse their own troughs every spring can still be carrying 16 years of buildup underneath. It comes out by hand, in clumps, and it comes out heavier than anyone expects.

The main downspout was on the neighbour's property

Quick answer: 1 of the 2 households owns the pipe, the other owns the water. This is an attached home, and the downspout carrying the main roof run to the ground sits past the property line on the neighbour's side. Flushing it meant putting a ladder and a hose on someone else's land, so our technician knocked on the door first and showed the photos from the roof.

Attached housing hides this. From the street you see two front doors, two driveways and what looks like two separate roofs. Go up a ladder and the roofline is continuous, the trough runs straight across the join, and the water from one household's slope is already travelling toward a pipe that belongs to a different address. The shingle colour changes at the property line in the photo below. The eavestrough does not.

Our technician went next door, explained what was being done to the client's system, and showed the neighbour the before and after photos from the roof on his phone. The neighbour agreed. Every downspout on the house was then flushed with water, including the one on the far side of the line, and the neighbour was shown the video of it running clear. That conversation took about five minutes. Skipping it would have left the most important pipe on the property untested, which is the part homeowners never find out about until the first heavy rain of October.

A downspout you have not been allowed to test is a downspout you have not cleaned. The paperwork on the roof is easy. The five minutes at the neighbour's door is the job.

Whose water is it once the trough collects it?

Quick answer: Yours. Ontario draws 1 hard line, and it falls between water that runs off naturally and water a system has gathered up. The province names eavestroughs and downspouts as collected surface water, and says whoever collects it has to discharge it where it will not cause problems for a downstream owner.

The provincial guidance on surface water and drainage disputes puts it plainly: the flow of uncollected surface water onto an adjoining property is not grounds for a lawsuit, but once you collect that water you take on an obligation to discharge it somewhere it will not cause problems for a downstream owner. Rain landing on a bare slope is nobody's fault. The same rain, gathered along a whole roof edge and sent down one pipe, is a decision, and the law treats it as one.

That single distinction changes how you should read a blocked downspout. When the pipe backs up, your system stops being a collection system and starts being a sprinkler aimed at whatever is below the overflow point, which on an attached home is frequently not your own foundation. The homeowner in this case had never framed it that way. Almost nobody does, right up to the point where someone else's basement is wet.

What Burlington's own by-law says about downspouts

Quick answer: Burlington By-law 17-2018, the City of Burlington Drainage By-law, defines a "drain" to include an eavestrough downspout discharge pipe. Section 5.1 bars any person from obstructing a drain or contributing to its obstruction, and 5.2 puts repair and maintenance on the owner of the land the drain sits on.

It is worth reading the definition, because it is broader than most homeowners assume. In By-law 17-2018 a drain means a ditch, swale, culvert, pipe, sump pump discharge pipe, "eavestrough downspout discharge pipe", rain water leader or storm sewer. Your downspout is a municipally defined drain in Burlington, in the same sentence as the storm sewer.

Section 5.1 then says no person shall alter, fill, obstruct, block or in any way interfere with a drain, or cause or contribute to the obstruction of a drain, or change the grading or drainage pattern of a property so as to affect the drainage of another. Section 5.2 adds that the owner of the land on which a drain is located has to repair and maintain it, and has to maintain drainage on their own property without causing undue harm or damage to neighbouring properties. Read those two together on an attached home and you get the awkward answer: the pipe is the neighbour's to maintain, the water in it is yours to be responsible for, and neither of you can fix that alone.

This is a description of what the by-law says, not legal advice. If a drainage question between two properties has already turned into a dispute, the City and a lawyer are the right calls, in that order.

Can you step onto your neighbour's land to fix it?

Quick answer: Sometimes, and only where your municipality has passed a by-law allowing it. Section 132 of Ontario's Municipal Act, 2001 lets a city authorise an owner to enter adjoining land to make repairs. Toronto, Ottawa and Brampton have done so. Many municipalities have not, and there consent is the only route.

Section 132 of the Municipal Act, 2001 is the enabling provision. It does not give you the right by itself; it gives your city the power to grant one, and the cities that took it up did so in different ways. Ottawa runs it as a formal permit under its Right of Entry By-law No. 2005-326. Brampton's version is nicknamed the Friendly Neighbour by-law, and the scenario its own report describes is almost word for word the situation on this Burlington roof: a homeowner whose side yard is too narrow, who needs to set the foot of a ladder on the property next door to reach their own second storey.

Where a right of entry does exist, it is narrow. Toronto's page on the right to enter a neighbour's land for repairs sets out the conditions. The work has to be impossible from your own property or the street. You give at least 24 hours written notice describing the work and how long it will take. You may not climb onto any building on their land, store materials there or park there. Afterwards you restore the land and pay for any damage. A municipal by-law also does not override the provincial Trespass to Property Act.

Practically, none of that beats knocking. Written notice is a fallback for neighbours who say no. What worked here was a phone full of photographs and a person willing to explain what he was doing and why.

Reseal the joints, or replace the system?

Quick answer: On a 16-year-old aluminium system with sound troughs, resealing the downspout joints is the correct repair, not a delaying tactic. The trough body outlasts its sealant by decades. Ask an AI assistant the same question and it will steer you toward replacement, because almost every page it can read was written by a company that installs new systems.

We tested that. On August 25, 2026 we asked OpenAI's GPT-4.1 model, with web search enabled, whether a 16-year-old system with dripping downspout joints needs replacing. It answered that "a complete replacement might be more cost-effective in the long run" and listed five installers serving Burlington and Oakville. Not one line of the answer mentioned cleaning and resealing as an option, and no price for the repair appeared anywhere. The model was not being dishonest. It was summarising a corner of the web where every author sells replacement.

Here is the part those pages leave out. Sealant is a consumable and the aluminium is not. The joints where a downspout outlet meets the trough, and the mitred corners, are where a system leaks first, because those are the only places the sealant is doing structural work rather than the metal. When the old bead goes hard it stops moving with the metal through Ontario's freeze and thaw, cracks, and weeps. Scraping that out and laying a fresh bead of exterior sealant is a small job. On this house it happened during the cleaning visit, at the downspout outlets, without a second appointment. Corner work of the same kind runs $40 to $50 per corner.

Replacement earns its price when the trough itself has failed: rust holes, split seams that will not hold a bead, sections deformed by ice, or fascia rotted behind the hangers. None of that was present here. A homeowner who had accepted the first answer would have spent thousands to solve a problem that cost a tube of sealant.

The hangers nobody checks

Quick answer: Several hangers on this Burlington run had worked loose and were re-secured during the same visit. A loose hanger is not cosmetic. It lets one section of trough drop below its neighbours, which creates a low point, and a low point holds water for the next 16 years.

Fasteners loosen for a mundane reason: the trough gets heavy, then light, then heavy again. Sixteen years of soil sitting in it, plus the weight of every rainfall and every ice load, works against the fixings the whole time. Once a hanger has backed out a few millimetres the section it holds hangs slightly lower, and water that should be moving toward the outlet stops there instead.

You can see it from the ground if you know what to look for. Sight along the underside of the trough from one end. It should read as a straight line with a very slight fall toward the downspout. A visible sag, a gap between the trough and the fascia, or a hanger you can see daylight through all say the same thing. The flush test, and why we filmed it

Quick answer: On August 24, 2026 every downspout on the house was flushed with water at the end of the visit, including the pipe standing on the neighbour's land, and each run was filmed. An empty-looking trough proves nothing. Water is the only test that finds a blockage in the vertical section of pipe, where you cannot see and cannot reach.

Clearing a trough by hand deals with what is in the horizontal channel. The downspout is a sealed pipe from the outlet at the top to the elbow at the bottom, and a plug of compacted debris can sit anywhere along it, invisible from both ends. The only honest check is to put water in at the top and stand at the bottom to watch what comes out, and how fast.

The video matters for the same reason the conversation next door mattered. When the downspout you tested is on someone else's property, "we flushed it and it ran clear" is a claim. Footage of water leaving the elbow is evidence, and it was shown to both households. If you have never seen your own downspouts tested, ask whoever cleans them next to run water through and stay to watch it come out.

What else the ladder showed

Quick answer: 2 things worth reporting that the homeowner could not have seen from the ground: a lifted shingle at the roof edge sitting proud of the course below it, and heavy granule loss into the trough. Neither was an emergency. Both belong in a note to the owner rather than in a bin bag.

A cleaning visit is the only time most houses get looked at from four feet away, and the view is wasted if nobody writes down what is there. The lifted shingle in the photograph has lost the seal strip that bonds it to the tab below, so wind can get underneath it. On its own that is a small repair. Ignored through a winter of freeze and thaw it becomes a place where water gets in behind the edge, and the fascia the eavestrough is screwed to is directly below.

The granules are the second note. Asphalt shingles shed grit for their whole life and the trough is where it collects, so a heavy layer of it on a 16-year-old roof is normal rather than alarming. It is still worth recording, because the same measurement in five years is what tells the owner whether the roof is ageing at the rate it should. That is the argument for a company that photographs what it finds instead of just taking the debris away.

Quick answer: 4 steps, in order. Find out where your downspouts land. Talk to the neighbour before there is a problem to talk about. Get the flush test filmed. And check your municipality's position on right of entry before you need it, not on the morning you do.

Who is responsible for a downspout that sits on my neighbour's property?

Both of you, for different parts of it. Burlington By-law 17-2018 section 5.2 puts repair and maintenance of a drain on the owner of the land it is located on, so the pipe is theirs. Ontario treats the roof water your eavestrough collects as your responsibility to discharge safely. Neither side can resolve a blockage alone.

Can a neighbour drain water onto your property in Ontario?

Uncollected runoff, yes. Ontario's guidance on drainage disputes states that the flow of uncollected surface water onto an adjoining property is not grounds for a lawsuit. Collected water is different: once a system such as an eavestrough and downspout gathers it, the owner who collected it has an obligation to discharge it where it will not cause problems downstream.

Do I need my neighbour's permission to have my eavestroughs cleaned?

Only if part of the work has to happen on their land. On a detached home the answer is almost always no. On an attached home or a narrow lot where a downspout or the base of the ladder lands past the property line, you need consent unless your municipality has passed a right-of-entry by-law, and even then written notice usually applies.

Can I legally put a ladder on my neighbour's lawn to reach my own roof?

It depends on your city. Section 132 of Ontario's Municipal Act, 2001 lets a municipality authorise entry onto adjoining land for repairs, and Toronto, Ottawa and Brampton have passed by-laws doing so. Ottawa requires a permit. Where no such by-law exists, entering without consent is trespass under the provincial Trespass to Property Act.

What notice do I have to give before entering a neighbour's land for repairs?

In Toronto, at least 24 hours in writing, describing the work, the date, how long it will take and your phone number, delivered in person or by registered mail.
